1 Interpretation and Variation
1.1 In these Terms and Conditions the following definitions apply:
“Member” means any person that has completed a Registration Form which has been accepted by Hot Spot Yoga and has a valid Membership that has not expired.
“Class” means a class provided by or on behalf of Hot Spot Yoga at the Studio.
“Class Pass” means the membership that entitles a Member to attend the number of Classes purchased before the expiry date of the pass.
“Single Class” means the membership that entitles a Member to attend a class before the expiry date of the class.
“Registration Form” means the registration and/or application form completed by a Member whether electronically or otherwise.
“Studio” means any of Hot Spot Yoga’s studio as published on the Website from time to time.
“Terms and Conditions” means these terms and conditions.
“Website” means www.hotspotyoga.co.uk
1.2 These Terms and Conditions are incorporated into the Registration Form and any Membership is subject to these Terms and Conditions as amended from time to time.
1.3 Hot Spot Yoga reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of the Studio and/or the conduct of Members. Any such changes will be published on the Website and, until revoked, are binding on Members.
Limitation of Liability
2.1 In consideration of Hot Spot Yoga accepting a person as a Member, the Member agrees that:
2.1.1 Neither Hot Spot Yoga, nor its partners, instructors and employees are responsible for any injuries suffered by the member caused whole or in part by the Member’s failure to faithfully follow the instructions of the instructor or by any physical impairment of mine not fully disclosed to the Studio in writing.
2.1.2 Neither Hot Spot Yoga, nor its partners, instructors and employees are responsible for loss or damage to a Member’s personal belongings.
2.1.3 Hot Spot Yoga reserves the right to change the class schedule, including cancellation of individual classes and change of instructor without notice. If a cancellation takes place, customers who have booked a place in the class with a valid unlimited class agreement may book another qualifying class using their unlimited membership at their discretion. Customers who have booked a place in the class with limited class passes will be refunded class credits used to secure a place in the class.
2.1.4 Hot Spot Yoga reserves the right at any time to withdraw all or part of its facilities or Classes for any period or periods, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or Hot Spot Yoga. If a cancellation takes place, customers who have booked a place in the class with a valid unlimited class agreement may book another qualifying class using their unlimited membership at their discretion. Customers who have booked a place in the class with limited class passes will be refunded class credits used to secure a place in the class. Classes will be cancelled if there is a student class size of 3 of less or due to a teacher sickness and cover can not be provided.
3 Online Bookings
3.1 Class size is limited and Hot Spot Yoga operates a “first come first served” booking policy.
3.2 All unallocated spaces are returned to “first come first served” spaces for that class.
3.3 A booking can only be claimed by attending at reception and advising the receptionist you are present.
3.4 A Member arriving with less than 5 minutes before the start of class is not guaranteed a space in that class.
3.5 Any Member who regularly books online and fails to show up for class without cancelling will be blocked from booking online.

4 Use of Facilities and Children
4.1 Classes start promptly at the advertised times. Members need to arrive at the Studio with enough time to change and enter the yoga studio before the class starts. Members arriving at reception once the instructor has started class will not be allowed to attend that class.
4.2 Members are entitled to use the Studio facilities when attending a class and not as a place to shower before work nor used as a place to prepare for an evening out.
4.3 The yoga studio is a SILENT space. Many members use the time before or after class for meditation.
4.4 Bicycles are to be left in the bicycle store and are not permitted anywhere within the building.
4.5 All lost and left property is disposed of within 7 days with the exception of towels which are disposed of on a daily basis.
4.6 Children over the age of 7 may not enter changing rooms or other areas reserved for the opposite sex, regardless of whether they are accompanied by an adult.
5 Fitness and Health
5.1 All students are required to fill all medical and personal information on their Mindbody account in order to attend any yoga classes. This information must be completed prior access to the studio.
5.2 Classes involve intensive exercise in room temperatures and heated room. Each Member agrees to familiarise themselves with what constitutes a Hot Yoga class prior to assessing whether they are fit to participate in a Class. Members should refer to the Website or speak to a member of staff for further information.
5.3 Each Member warrants and represents on the date of their acceptance of these Terms and Conditions and on each occasion that the Member uses the Studio that the Member is in good physical condition and that the Member knows of no medical or other condition why the Member is not capable of engaging in the Classes or exercises provided by Hot Spot Yoga and that such Classes or exercises would not be detrimental to the Member’s health, safety or physical condition.
5.4 Hot Spot Yoga staff are not medically trained and are therefore not qualified to assess whether the Member or any guest is in good physical condition and/or that the Member can engage in any exercise without detriment to the Member’s health, safety, comfort or physical condition.
5.5 Members are advised not to undertake any physical activities without first seeking medical advice if they have concerns over their physical condition or if they have answered 'Yes' to any of the health screening questions upon creating an account with Hotspot Yoga. Hot Spot Yoga reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of Hot Spot Yoga’s facilities. Hotspot Yoga LTD will not be held liable for any health related complications that may arise as a result of a member withholding information on the health screening form and/or not seeking advice from a physician before attending a class at Hotspot Yoga if they have answered yes to any health screening question. The member accepts all liability for any health related complications that may arise as a result of a member withholding information on the health screening form and/or not seeking advice from a physician before attending a class at Hotspot Yoga if they have answered yes to any health screening questions.
5.6 Members shall not use Hot Spot Yoga’s facilities if they are suffering from: low/high blood pressure, cardiac irregularities, any infectious or contagious illness, disease or other ailment or suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the health safety, comfort or physical condition of the other Members. If there is any doubt, Members should consult their doctor and must notify Hot Spot Yoga of any circumstances affecting their health which may be exacerbated through continued use of the Studio.
5.7 Members are required to faithfully follow all instructions given by the instructor at all times.
6 Personal Belongings, Dress & Safety
6.1 For security reasons Members are responsible for their own valuables. You may leaves items at reception at your own risk.
6.2 Members are requested to wear clothing that preserves their dignity throughout the full range of movement that constitutes a Hot Yoga Class. Underpants, thongs underneath tights, swimming costumes are not considered appropriate.
6.3 Hot Spot Yoga is a shoe free zone. All outdoor footwear is to be removed as soon as possible and not worn from reception onwards.
6.4 For safety reasons and because all Members are barefoot – No crockery, glass or anything breakable is permitted in any part of the Studio.
6.5 No food is to be consumed within the yoga studio.
6.6 Members should not walk around the Studio barefoot if they have verrucas or similar foot complaints.
6.7 Members are required to use a suitable towel for the purpose of covering their yoga mat in the studio.
6.8 In the event of a fire, Members are asked to make their way to the nearest available exit.
7 General
7.1 Details of Class times at the Studio may vary from time to time and are published on the Website. Hot Spot Yoga reserves the right to change Class times or cancel Classes at its discretion and will endeavour to give Members notice of such changes as is reasonably practicable. Classes with zero students signed in two hours prior the starting time will be cancelled due to the heating system of the studio needing to be programmed in advance.
7.2 Members must at all times observe Hot Spot Yoga’s guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the safety of the Members and the smooth operation of the Studio for the convenience of all Members.
7.3 Members consent to having their photograph taken by Hot Spot Yoga at any time whilst using the Hot Spot Yoga facilities and Hot Spot Yoga reserves the right to use any such individual or group photographs of members and/or guests for press or promotional purposes. If a Member specifically does not want their photograph used for such purposes then they must notify Hot Spot Yoga in writing.
7.4 Members are required to give written notice to Hot Spot Yoga of any change of address or email.
7.5 Hot Spot Yoga may communicate with the Member by email. By providing an email address to Hot Spot Yoga the Member consents to receiving email communications from Hot Spot Yoga, including notices pursuant to these Terms and Conditions. The Member also accepts the risk that email may not be a secure and confidential means of communication. Hot Spot Yoga will not be liable for any loss or damage suffered as a result of communicating with a Member by email.
7.6 Hot Spot Yoga reserves the right to refuse admission to the Studio.
8 Class Pack Expiry
8.1
single class pass = expires 14 days from date of purchase
4 class pass = expires 1 month from date of purchase
6 class pass = expires 2 months from date of purchase
8 class pass = expires 2 months from date of purchase
10 class pass = expires 3 months from date of purchase
8.2 Hot and warm/room temperature passes can not be transferred between class type. i.e a room temperature single class pass cannot be used to book a hot class
9 Refund/Cancellation Policy
9.1.1 Unused, part used and unexpired Pre-Paid Class packs are non-refundable and non-transferable.
9.1.2 Passes due to expire can be extended providing you purchase another identical class pass package before the remaining passes expire. Once you have made the purchase contact hotspotyogauk@gmail.com. Passes due to expire will be carried forward to your new class pass expiry date. This does not apply to promotion passes.
9.1.3 Early cancellations (up to three hours before the scheduled start of a class) will not result in loss of the pass used to book. Late cancellations (less than three hours of scheduled start of class) will result in use of pass regardless of attendance. The same applies to special offers where free passes are given, for example buy one get one free, Easter offers and summer sizzlers.
9.2 6 Month Yogi pass requires 60 days cancellation notice in writing to cancel. 3 Month Journey Pass requires 30 days notice in writing to cancel.
9.3 If you fail to cancel your booking online at least 3 hours before the class starts and you fail to turn up, that class will be taken off your class card. if you are a member, on any permanent or temporary Offer or Monthly Unlimited (e.g. Summer Escape) a No Show Fee of £5 will be charged to your account.
9.4 If you fail to keep up payments on a 3 month or 6 month membership this may result in Hotspot Yoga taking legal action to recover the remaining balance. Cancellations for 3 month memberships are 30 days notice and 6 month memberships are 60 days notice in writing. These memberships cannot be cancelled online. Before you make this agreement please make sure you are able to attend as the only exclusions are for pregnancy or ill health when supported by a doctors note.
Promotions
10.1 Taster Sessions are a free class to any new student that signs up to hotspot Yoga via Mindbody. The student can come along to one free session to experience the studio before making a financial commitment.
